Committee Meeting
July 20, 2006
The meeting was called to order by the Chair, P. Michels, at 3:30 p.m. Members present were D. Boettcher, J. Dahl, M. Holte, P. Licht, P. Michels, and L. Willkom.
Members absent were L. Marquardt.
Agency staff present were J. Sazama (Corporation Counsel), M. Dahlby, A. Heddlesten, D. Masterpole, J.T. Jensen, A. Wellnitz, R. Yohnk, and J. Schemenauer - Recorder (LCD).
Item #1 - Review Minutes.
The minutes from the 6/15/06 and 6/20/06 LCC meetings were presented. Motion to approve the 6/15/06 and 6/20/06 minutes, as presented: Boettcher/Dahl. Motion carried.
Item #2 - Closed Session.
Motion to convene into closed session at approximately 3:35 p.m., according to WI Statutes 19.85(1)(e) to deliberate or negotiate the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session: Holte/Dahl. Roll call to convene into closed session: D. Boettcher - Aye, J. Dahl - Aye, M. Holte - Aye, P. Licht - Aye, P. Michels - Aye, and L. Willkom - Aye. Motion carried.
Item #3 - Reconvene to Open Meeting.
Motion to come out of closed session at approximately 4:20 p.m.: Holte/Dahl. Roll call to convene to open session: D. Boettcher - Aye, J. Dahl - Aye, M. Holte - Aye, P. Licht - Aye, P. Michels - Aye, and L. Willkom - Aye. Motion carried.
J. Sazama presented a report to the Committee.
The Committee directed the County Conservationist to pursue a real estate acquisition in Chippewa County as to real estate described as:
E ½ of the NE 1/4 of the NW 1/4, the E ½ of the SE 1/4 of the NW 1/4 and the
SW 1/4 of the NE 1/4 all in Section 16, Twp. 28N, Range 8W.
Item #4 - Review Process, Schedule, and Terms of Recycling Service Contract Renewals: Midwest Recycling Association & City of Chippewa Falls.
P. Michels presented A. Wellnitz a certificate of appreciation for five years of service to Chippewa County.
R. Yohnk distributed and the Committee reviewed a handout titled: Review Process, Schedule, and Terms of Recycling Service Contract Renewal - City of Chippewa Falls, (LCC 7/20/06). The handout outlines:
A. The type and extent of technical services currently provided by the County in support of the City of Chippewa Falls Recycling Program.
B. Minor changes to the terms of the contract, which are proposed if the contract is to be renewed.
There was general discussion.
The LCC concurred with the proposed contract changes and authorized staff to enter discussions with the City of Chippewa Falls (Committee #4), to renew the contract, as outlined in the proposal.
R. Yohnk distributed and the Committee reviewed a handout titled: Review Process, Schedule, and Terms of Recycling Service Contract Renewal - Midwest Recycling Association , (LCC 7/20/06). The handout outlines:
A. The type and extent of technical services currently provided by the Midwest Recycling Association to Chippewa County in support of the Chippewa County Recycling Program.
B. The fact that the current agency representative (A. Wellnitz) has resigned from the position effective August of 2006, and that Chippewa County has cancelled an associated contract for services with the Midwest Recycling Association.
C. A staff recommendation that a new contract be sought to maintain the historic level of program services, within the constraints of existing budget caps, using a Request for Proposals (RFP) process.
There was general discussion.
The LCC concurred with the process which will be used to replace the contract, and the terms of the contract as outlined in the proposal.
A. Wellnitz distributed and the Committee reviewed a draft survey titled: Chippewa County Recycling Program Voluntary Municipal Recycling Survey, (June, 2006). The survey has been developed to evaluate the adequacy of local recycling services in Chippewa County and to invite suggestions for improvement. The survey will be sent to municipalities that participate in the Chippewa County Recycling Program R.U. (Responsible Unit). Results of the survey will be compiled and shared with participants.
Item #5 - Overview and Results of Manure and Nutrient Management Compliance Monitoring.
L. Richardson distributed and the Committee reviewed the following material:
A. Spreadsheet titled: Chippewa County Producers Required to Have Nutrient Management Plans. The spreadsheet is a master list of agricultural producers and their consultants who maintain nutrient management plans to meet permit requirements under the Chippewa County Animal Waste Storage Ordinance.
B. Spreadsheet titled: 2006 Compliance of Nutrient Management Plans - June 28, 2006. The spreadsheet is a detailed listing which outlines the permit data and compliance status of each producer.
L. Richardson presented a Power Point presentation (7/20/06 on file). The presentation provides an overview and results of nutrient management compliance monitoring in Chippewa County.
Results show that:
A. All producers under permit are in substantial compliance with the 590 nutrient management standard.
2. To assure public accountability, it will be necessary for the County to monitor permits to assure that requirements for annual record keeping are met.
There was general discussion.
Item #6 - Overview and Results of Non-Metallic Mining Reclamation Compliance Monitoring.
A. Heddlesten presented a Power Point presentation (7/20/06 on file). The presentation provides an overview and results of non-metallic mining reclamation compliance monitoring.
Results show that:
A. All nonmetallic mining operations, that are subject to the jurisdiction of the County Non-Metallic Mining Reclamation Ordinance, have a permit (78).
B. 72 of the 78 have an approved reclamation plan on file.
C. 38 of the 72 operations have met their obligation to secure financial assurance.
There was general discussion.
D. Masterpole distributed and the Committee reviewed the following material:
1. Agreement titled: Storm Water Management Public Education and Outreach Cooperative Agreement, (April, 2006). The agreement specifies the responsibilities of Eau Claire County and Chippewa County in the implementation of a shared storm water education and outreach program.
2. Addendum Agreements signed by the following municipalities:
•City of Eau Claire Addendum to Storm Water Management Public Education and Outreach Cooperative Agreement, (May, 2006).
•Town of Washington Addendum to Storm Water Management Public Education and Outreach Cooperative Agreement, (May, 2006).
•Town of Seymour Addendum to Storm Water Management Public Education and Outreach Cooperative Agreement, (May, 2006).
•Town of Union Addendum to Storm Water Management Public Education and Outreach Cooperative Agreement, (May, 2006).
•Addendum to Storm Water Management Public Education and Outreach Cooperative Agreement, (May, 2006) - City of Altoona.
•City of Menominee Addendum to Storm Water Management Public Education and Outreach Cooperative Agreement, (May, 2006).
•City of Chippewa Falls Addendum to Storm Water Management Public Education and Outreach Cooperative Agreement, (June, 2006).
There was general discussion regarding Chippewa County’s responsibilities under the agreement.
To meet part of it’s responsibility, Chippewa County will sponsor a stormwater educational training session for municipal officials and industry representatives in 2007.
Item #8 - Appoint Land Conservation Committee Member to Ad Hoc Committee to Study Development Issues in the Agriculture Districts.
D. Masterpole provided an overview of Resolution #4-06 titled: Resolution to Establish Ad-Hoc Committee to Study Development Issues in the Agriculture Districts, (adopted 2/14/06).
The resolution specifies that 2 representatives each from the Agricultural and Extension Committee, the Economic and Industrial Development Committee, the Land Conservation Committee, and the Zoning Committee be recommended by their respective committee chairs to select members of an ad-hoc committee to study development issues in agricultural districts.
On 3/16/06, the LCC appointed D. Boettcher and J. Dahl as Land Conservation Committee representatives to the Ad Hoc Committee. That Ad Hoc Committee met once and agreed to limit its membership to one representative from each of the designated committees.
To meet this recommendation, the Zoning Department has recently asked that the LCC now appoint one representative to the Ad Hoc Committee.
Motion to appoint P. Licht as the LCC representative to the Ad Hoc Committee to study development issues in agricultural districts with D. Boettcher as the alternate representative: Willkom/Dahl. Motion carried.
Item #9 - Review Bills. Review Summary of Plans/Contracts/Agreements.
The LCD program bills, Duncan Creek project bills, and Recycling program bills were presented. Motion to approve bills: Boettcher/Willkom. Motion carried.
There were no plans, contracts, or agreements presented.
Item #10 - Adjourn.
The next scheduled joint Committee tour has been scheduled for Wednesday, August 16, 2006. The next regular LCC meeting has been scheduled for Thursday, August 17, 2006, at 3:30 p.m.
